West Kelowna Retaining Wall Guidelines: A permit is required for a landscape retaining wall that is more than 4.9 ft tall. Construction of a retaining wall from 4.9 to 8.2ft requires a building permit and Engineered design. Retaining walls shall not be closer than 6.6ft apart. The construction of a retaining wall that is higher than 8.2ft is not permitted without a Development Variance Permit. Setbacks are not required from the property line. Retaining walls under 4.9ft do not require a permit, however, the location of the retaining wall should be confirmed with the Building Division staff.

The City of Kelowna states:  retaining walls on residential lots, except those required as a condition of subdivision approval, must not exceed a height of 3.94ft measured from grade on the lower side.Should a two tier retaining wall be constructed, the walls are required to be spaced a minimum of 3.94feet horizontally to comply with the provisions of the Zoning Bylaw. Where a retaining wall is designed with a fence installed on top, the combined height cannot exceed 6.6ft  maximum (the retaining wall portion is not to exceed 3.94ft in height) as per section 7.5.11.A DVP for overheight retaining walls (more than 3.94ft in height) is required and must be applied for and approved by Council. A corresponding building permit application, complete with sealed engineered drawings and schedules (B1, B2 and D) must be submitted and approved prior to the start of construction of the retaining wall.
